By visiting our website, creating an account, placing an order, booking a service, submitting information, or otherwise using the Services, you agree to these Terms and any additional policies referenced in them, including our Privacy Policy and Return Policy.

If you do not agree to these Terms, you may not access or use the Services.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell products and services to you.

We may add, remove, or modify features and Services from time to time. New features and Services will also be governed by these Terms.

SECTION 1 — ELIGIBILITY AND ONLINE STORE TERMS

You must be at least the age of majority in your state, province, or country of residence to use the Services independently. If you are under the age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian.

You may not use the Services, our products, or our content for any illegal, unauthorized, fraudulent, or abusive purpose.

You may not introduce viruses, malicious code, or other harmful material into the Services or interfere with their security or operation.

We reserve the right to refuse or discontinue service where permitted by law, including when we reasonably believe a transaction or use of the Services violates these Terms, presents a risk of fraud or harm, or is otherwise unlawful.

SECTION 3 — INFORMATION PROVIDED ON THE WEBSITE

We work to provide accurate, complete, and current information. However, information on the website may occasionally contain errors, omissions, or outdated material.

Website content is provided for general informational purposes and should not be treated as the sole basis for making decisions without reviewing other appropriate sources.

We may update, correct, or remove website content at any time. We are not required to update historical information except where required by law.

Product packaging, ingredients, instructions, and other information may change. You should always review the information included with the product you receive before using it.

SECTION 4 — PRODUCTS AND PRODUCT INFORMATION

Certain products may be offered exclusively online and may be available only in limited quantities.

We make reasonable efforts to display product colors, packaging, texture, finish, and other visual details accurately. However, colors and images may appear differently depending on your screen, device settings, lighting, or other factors.

Because some of our products use naturally derived ingredients, minor variations in color, texture, consistency, appearance, or aroma may occur between batches. These normal variations do not necessarily indicate that a product is defective.

Fragrance, scent strength, product feel, and individual results are inherently subjective and may vary based on personal preference, application, skin or hair type, environment, and other factors.

Product descriptions and pricing may be changed at any time without notice. We may discontinue products or limit available quantities at our discretion.

We do not guarantee that a product will meet every individual preference or produce the same results for every person.

Any offer for a product or service is void where prohibited by law.

SECTION 5 — PERSONAL-CARE AND WELLNESS INFORMATION

Information provided through our website, product descriptions, social media, consultations, or customer service is intended for general informational purposes only.

Our products and Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing provided through the Services constitutes medical advice.

When appropriate, perform a patch test before fully applying a new personal-care product. Discontinue use and seek appropriate advice if irritation or another adverse reaction occurs.

SECTION 6 — ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the products or services listed in your order.

An automated order confirmation acknowledges that we received your order but does not necessarily mean that we have accepted it. We may accept an order by processing payment, beginning fulfillment, shipping the order, or otherwise confirming acceptance.

We reserve the right to refuse, limit, or cancel an order where permitted by law. This may include orders that:

• Violate purchase limits or promotional terms.

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

We may limit quantities purchased by the same person, household, customer account, payment method, billing address, or shipping address.

Orders intended for resale, retail distribution, or other commercial purposes require prior written approval through our wholesale program.

SECTION 7 — BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate account, billing, shipping, and payment information.

You are responsible for promptly updating information that changes so we can process transactions and contact you when necessary.

You represent that you are authorized to use the payment method submitted with an order.

Payments are processed by Shopify and other payment-service providers. Your use of those payment services may also be subject to the provider’s terms and privacy practices.

We may use fraud-prevention tools and may request additional information to verify an order.

SECTION 8 — PRICES, PROMOTIONS, AND DISCOUNTS

Prices are displayed in the currency indicated at checkout and may change without notice.

Taxes, shipping charges, duties, and other applicable fees may be added during checkout.

Promotional codes, discounts, gifts with purchase, and other offers:

• May be subject to separate terms.

• May be limited to eligible products, customers, dates, or regions.

• May not be combined unless expressly stated.

• Have no cash value unless required by law.

• May be changed, suspended, or canceled if an error, fraud, abuse, or technical problem affects the promotion.

Only one promotional code may be used per order unless otherwise stated.

If a promotion contains a clear error, we may correct the error or cancel affected transactions as permitted by law.

SECTION 9 — SHIPPING AND DELIVERY

Shipping and delivery dates are estimates and are not guaranteed.

Delays may occur because of carrier operations, weather, customs, incorrect address information, high order volume, holidays, supply interruptions, or events outside our reasonable control.

You are responsible for providing a complete and accurate shipping address before submitting an order.

If you notice an address error, contact us as soon as possible. We cannot guarantee that an address can be changed after fulfillment begins.

Once an order has been transferred to a shipping carrier, tracking updates and delivery scans are generally controlled by that carrier.

International customers are responsible for applicable duties, taxes, customs fees, import restrictions, and other charges unless otherwise stated at checkout.

Additional shipping terms displayed during checkout or in our shipping information are incorporated into these Terms.

SECTION 10 — RETURNS, REFUNDS, AND REPLACEMENTS

Returns, refunds, exchanges, and replacements are governed by our Return Policy.

Eligibility may depend on the product, its condition, the purchase date, delivery date, reason for the request, and other requirements stated in the Return Policy.

Certain products may be final sale or ineligible for return due to hygiene, safety, promotional, or other stated reasons.

Shipping charges, duties, taxes, and return-shipping expenses may be nonrefundable except where otherwise stated or required by law.

If these Terms conflict with a more specific written return, replacement, or promotional policy, the more specific policy will control for that transaction.

You may be able to create an account to access order information, checkout features, or other Services.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree to notify us promptly if you believe your account has been accessed or used without authorization.

We may suspend or close an account if we reasonably believe it is being used fraudulently, unlawfully, abusively, or in violation of these Terms.

SECTION 12 — JACK HENRY STUDIOS AND APPOINTMENTS

Appointments and in-person services offered through Jack Henry Studios may be subject to additional booking, cancellation, deposit, late-arrival, and no-show policies displayed when the appointment is scheduled.

You are responsible for providing accurate information relevant to your requested service and informing the service provider of known allergies, sensitivities, injuries, or other concerns that may affect the service.

Results from hair, skin, grooming, or other personal-care services vary between individuals and are not guaranteed.

Studio services are not medical services and are not a substitute for medical treatment or professional healthcare advice.

We may decline, modify, stop, or reschedule a service where reasonably necessary for health, safety, staff availability, inappropriate conduct, or other operational reasons.

You are responsible for reviewing the specific terms presented during booking.

SECTION 13 — WHOLESALE, AFFILIATE, AND BUSINESS RELATIONSHIPS

Submitting a wholesale, retailer, affiliate, creator, vendor, or partnership application does not guarantee approval or establish a business relationship.

Approved wholesale or business relationships may be governed by separate written agreements, purchase orders, pricing terms, policies, or program rules.

If a separate written agreement conflicts with these Terms, the separate agreement will control for the matters it specifically addresses.

Consumer promotions, discounts, shipping offers, and return policies generally do not apply to wholesale or other business purchases unless expressly stated.

SECTION 14 — THIRD-PARTY TOOLS AND SERVICES

The Services may provide access to tools, integrations, payment services, appointment platforms, account services, accessibility services, or other features operated by third parties.

We do not control every aspect of those third-party services and cannot guarantee that they will always be available, accurate, secure, or error-free.

Your use of a third-party service may be governed by separate terms and privacy policies provided by that third party.

To the extent permitted by law, Jack Henry is not responsible for harm resulting solely from your use of an independent third-party service.

SECTION 15 — THIRD-PARTY LINKS

The Services may contain links to websites, products, content, or services operated by third parties.

A link does not necessarily mean that we endorse or control the third party.

We are not responsible for the accuracy, availability, security, products, content, or privacy practices of independent third-party websites.

Review the applicable policies before completing a transaction or providing personal information to a third party.

SECTION 16 — REVIEWS, FEEDBACK, AND USER CONTENT

You may submit reviews, photographs, comments, feedback, suggestions, testimonials, or other content through the Services.

You retain any ownership rights you have in content you submit. By submitting content, you grant Jack Henry a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, edit, adapt, publish, display, distribute, and create derivative works from that content in connection with our business, marketing, and Services, subject to applicable law.

You represent that:

• You own or have permission to submit the content.

• The content is accurate and reflects your genuine experience where applicable.

• The content does not infringe another person’s intellectual property, privacy, publicity, or other rights.

• The content is not unlawful, fraudulent, threatening, defamatory, obscene, abusive, or misleading.

• The content does not contain malware, unauthorized advertising, or harmful code.

We may monitor, moderate, reject, edit, or remove submitted content where permitted by law, but we are not required to do so.

Do not submit confidential business information, trade secrets, or unsolicited product concepts that you expect us to keep confidential or compensate you for.

SECTION 17 — INTELLECTUAL PROPERTY

The Services and their content—including text, photographs, videos, graphics, product names, packaging, logos, trademarks, designs, software, and other material—are owned by or licensed to Jack Henry and are protected by intellectual-property laws.

You may access and use the Services only for lawful personal or internal business purposes consistent with these Terms.

You may not copy, modify, reproduce, publish, distribute, sell, license, scrape, create derivative works from, or commercially exploit our content without prior written permission.

“Jack Henry” and related names, logos, product names, and design elements are trademarks or trade dress belonging to Jack Henry or its licensors. No license to use them is granted except as expressly stated.

SECTION 18 — PERSONAL INFORMATION

Our collection and use of personal information is governed by our Privacy Policy.

By using the Services, you acknowledge that information may be processed by Shopify and other service providers as described in the Privacy Policy.

SECTION 19 — EMAIL AND SMS COMMUNICATIONS

By providing your email address or telephone number, you agree that we may send transaction-related communications concerning orders, appointments, accounts, support requests, or other Services.

Marketing email and SMS communications are sent only as permitted by law and consistent with the choices you make.

Consent to receive marketing text messages is not a condition of purchase. Message frequency may vary, and message and data rates may apply.

You can unsubscribe from marketing emails using the link included in the message. You can opt out of marketing texts by replying STOP.

Participation in our SMS program is also governed by the Mobile Messaging Terms.

SECTION 20 — ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, availability, ingredients, pricing, promotions, shipping charges, delivery estimates, or other information.

We may correct errors, update information, or cancel affected orders at any time, including after an order has been submitted.

If we cancel an order after collecting payment, we will issue an appropriate refund.

No stated update date should be interpreted as a representation that every part of the Services has been updated.

SECTION 21 — PROHIBITED USES

You may not use the Services:

• For any illegal, fraudulent, or unauthorized purpose.

• To violate any applicable law or regulation.

• To infringe our rights or the rights of another person.

Nothing in these Terms excludes or limits any warranty, guarantee, remedy, or consumer right that cannot legally be excluded or limited.

SECTION 23 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Jack Henry and its owners, directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to the Services, products, or these Terms.

This includes, where permitted by law, loss of profits, revenue, savings, opportunity, goodwill, or data.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other matters for which limitation is prohibited by law.

Where a jurisdiction does not permit a particular exclusion or limitation, our liability will be limited only to the maximum extent permitted by applicable law.

SECTION 24 — INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Jack Henry and its affiliates, owners, officers, directors, employees, agents, contractors, licensors, service providers, and suppliers from third-party claims, losses, liabilities, damages, and reasonable expenses arising from:

• Your material breach of these Terms.

• Your unlawful or unauthorized use of the Services.

• Content you submit.

• Your violation of another person’s rights.

This obligation does not apply to the extent a claim results from Jack Henry’s own unlawful conduct.

SECTION 25 — TERMINATION

These Terms remain effective while you use the Services.

You may stop using the Services at any time.

We may suspend or terminate your access if we reasonably believe you violated these Terms, engaged in fraud or abuse, created a security risk, or used the Services unlawfully.

Termination does not affect rights or obligations that arose before termination.

Sections that by their nature should continue after termination will remain effective, including provisions concerning intellectual property, user content, disclaimers, liability, indemnification, and governing law.

SECTION 26 — FORCE MAJEURE

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, severe weather, carrier interruptions, labor disputes, supply shortages, power or internet outages, cyberattacks, government actions, public-health emergencies, or transportation disruptions.

We will make reasonable efforts to resume affected Services when practicable.

SECTION 27 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 28 — WAIVER AND ASSIGNMENT

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other business transaction.

SECTION 29 — ENTIRE AGREEMENT

These Terms, together with the policies and additional terms referenced in them, constitute the entire agreement between you and Jack Henry concerning the Services.

They replace prior or contemporaneous communications and agreements concerning the same subject matter, except for any separate written agreement that expressly applies to you.

SECTION 30 — GOVERNING LAW

These Terms and any dispute arising from them or the Services are governed by the laws of the State of California, without regard to conflict-of-law principles.

Before initiating formal proceedings, you and Jack Henry agree to make a reasonable good-faith effort to resolve the dispute informally by contacting the other party.

Nothing in this section prevents either party from seeking relief in small-claims court where eligible or requesting emergency injunctive relief where appropriate.

Mandatory consumer protections provided by the laws of your place of residence remain unaffected where they legally apply.

SECTION 31 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our Services, business practices, technology, or legal obligations.

The updated Terms will be posted on this page with a revised “Last updated” date.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes to the extent permitted by law.
